This website is operated by Tea Runners Inc., operating as Tea Runners (“Tea Runners,” “we,” “us,” or “our”). Tea Runners offers this website, including all information, tools, products, subscriptions, and services available through this site, to you conditioned upon your acceptance of these Terms of Service (“Terms”).

By visiting tearunners.com (the “Site”), creating an account, purchasing a product or subscription, or otherwise using our services (collectively, the “Service”), you agree to be bound by these Terms and by any additional policies referenced in these Terms, including our Privacy Policy and Refund Policy.

Please read these Terms carefully before using the Site. If you do not agree to these Terms, you may not access the Site or use the Service.

Our store is hosted on Shopify Inc., which provides the ecommerce platform that allows us to sell products and services to you.

1. Eligibility and Online Store Use

By agreeing to these Terms, you represent that you are at least the age of majority in your province, state, or jurisdiction of residence, or that you are the age of majority and have given consent for any minor dependent under your supervision to use the Site.

You may not use the Site, our products, or the Service for any illegal or unauthorized purpose, or violate any laws in your jurisdiction in connection with your use of the Service.

You must not transmit viruses, malware, worms, or other code of a destructive or harmful nature.

A breach or violation of these Terms may result in the suspension or termination of your access to the Service.

2. Products and Product Information

We offer loose-leaf tea, tea subscriptions, tea boxes, teaware, gift products, and other related products through the Site.

We make reasonable efforts to describe and display our products accurately. However, tea is a natural agricultural product. Colour, appearance, leaf size, aroma, flavour, and other characteristics may vary somewhat by harvest, season, source, or batch. Product photographs and screen displays may not perfectly reflect actual product colours or appearance.

Product descriptions, product availability, tea selections, pricing, promotions, and other product information may be updated from time to time. We reserve the right to discontinue products or limit quantities available for purchase, subject to applicable law.

3. Prices, Orders, and Payment

Prices displayed on the Site are subject to change without notice before an order is placed. Applicable taxes, shipping charges, currency, discounts, and the total order price will be displayed during checkout as applicable.

You agree to provide current, complete, and accurate purchase, payment, shipping, and account information for all purchases made through the Site.

We reserve the right to refuse, limit, or cancel an order where reasonably necessary, including in cases of suspected fraud, unauthorized transactions, pricing or inventory errors, payment issues, shipping restrictions, or orders that appear to be placed for unauthorized resale. If we cancel an order after payment has been processed, we will issue an appropriate refund.

Payment card and other payment information is processed by the applicable payment provider selected at checkout. Subscription payment methods may be stored securely by our payment providers to process future authorized renewals.

4. Subscriptions and Automatic Renewal

Tea Runners offers automatically renewing tea subscriptions. Available subscription delivery frequencies may include:

  • Monthly;

  • Every 3 months;

  • Every 6 months; and

  • Every 12 months.

When you purchase an automatically renewing subscription, you authorize Tea Runners and its payment providers to charge the payment method associated with your subscription for each recurring order at the applicable subscription price, together with applicable shipping charges, taxes, and other disclosed charges, until you cancel or otherwise modify your subscription.

Your subscription will continue to renew automatically at the delivery frequency you selected unless you cancel it.

Managing Your Subscription

You may manage your subscription through your customer account, including cancelling, pausing, skipping a shipment, changing your delivery schedule, or changing available subscription selections, subject to any options and deadlines shown in your account.

To avoid an upcoming monthly processing cycle or shipment, subscription changes should be made by the last day of the month before the applicable order is processed.

Where applicable, customers may choose or update teas during the customization period offered for an upcoming subscription box. Available teas and customization options may change from month to month based on availability.

Cancelling or Refunding an Unshipped Subscription Renewal

If an unwanted subscription renewal has already been processed but the order has not yet shipped, please contact us promptly at support@tearunners.com. We can cancel and refund an unshipped subscription order.

Once an order has shipped, refunds, replacements, and returns are handled in accordance with our Refund Policy and any rights available under applicable law.

Changes to Subscriptions

We may change available subscription plans, tea selections, box contents, prices, delivery options, shipping charges, or other subscription features from time to time. Where required by applicable law, we will provide notice before changes apply to a future renewal or materially affect your subscription.

Where a subscription renews for a term longer than 60 days, we will provide advance renewal notice where required by applicable law.

Nothing in this section limits cancellation, refund, renewal-notice, or other rights you may have under applicable consumer protection laws.

5. Gift Subscriptions and Gift Cards

Gift subscriptions, prepaid products, digital gift cards, and physical gift cards may be available through the Site. The terms, duration, redemption conditions, and renewal status applicable to a gift or prepaid product will be disclosed at the time of purchase or on the applicable product page.

Gift cards may be used toward eligible purchases through the Site and are not redeemable for cash except where required by law.

A gift subscription will not automatically renew unless the product page or checkout process clearly indicates that the subscription renews automatically and the purchaser agrees to that renewal.

6. Shipping and Delivery

We ship orders to destinations made available through the Site, including customers in Canada and the United States.

Shipping methods, charges, estimated delivery timing, and tracking availability, if any, may vary based on destination, order type, product type, and shipping method. Information available at checkout or provided in order or shipment communications forms part of your order information.

Delivery times are estimates only and are not guaranteed, except where expressly stated or required by law. Carrier delays, customs delays where applicable, weather, service interruptions, incorrect or incomplete addresses, and other events outside our reasonable control may affect delivery timing.

You are responsible for providing an accurate and complete delivery address. If an order is missing, damaged, incorrect, or otherwise has a delivery issue, please contact us at support@tearunners.com so we can help make it right in accordance with our Refund Policy and applicable law.

7. Returns, Refunds, and Damaged or Incorrect Items

We accept eligible returns requested within 30 days after you receive your item, in accordance with our Refund Policy.

Unopened tea products may be eligible for return. Opened tea pouches cannot be returned. Eligible teaware may be returned in accordance with our Refund Policy.

If an item arrives damaged, defective, incorrect, or missing, please contact us promptly at support@tearunners.com. We will work with you to provide an appropriate replacement or refund.

Nothing in our Refund Policy or these Terms limits or excludes any rights or remedies that cannot be limited or excluded under applicable consumer protection laws.

8. Accounts

You may be required to create or access a customer account to manage subscriptions or use certain Site features.

You are responsible for keeping your account credentials confidential and for activity occurring through your account, except to the extent caused by our acts or omissions. Please contact us promptly if you believe your account has been accessed without authorization.

You agree to provide accurate information in connection with your account and to update your information as needed, including your email address, shipping address, and applicable payment information.

9. Email and SMS Communications

By providing your email address in connection with an order, subscription, or account, you agree that we may send transactional or service-related communications, including order confirmations, shipment communications, subscription notices, account notices, payment notices, and customer support responses.

If you opt in to marketing emails or SMS marketing, we may send promotional communications in accordance with your consent and applicable law. You may unsubscribe from marketing emails through the unsubscribe link provided in those messages.

SMS marketing is governed by the Mobile Terms of Service included below and by our Privacy Policy.

10. Optional Tools and Third-Party Services

We may provide access to third-party tools, integrations, links, payment methods, account features, or services over which we may not have complete control.

Your use of third-party services may be subject to the third party’s own terms and privacy policies. We are not responsible for third-party websites, tools, materials, or services except to the extent required by applicable law.

11. User Comments, Reviews, Feedback, and Submissions

If you submit reviews, feedback, suggestions, ideas, contest entries, images, or other materials to us (“Submissions”), you represent that you have the right to provide them and that they do not violate the rights of any other person or applicable law.

You grant Tea Runners a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, display, distribute, adapt, and otherwise use Submissions that you provide for purposes related to operating, promoting, or improving our business and products, unless otherwise agreed in writing.

You remain responsible for the accuracy and legality of your Submissions. We may remove or decline to publish Submissions that we reasonably believe are unlawful, misleading, offensive, infringing, fraudulent, or otherwise inappropriate.

Nothing in these Terms prevents you from posting an honest review or expressing your genuine opinion about our products or services.

13. Errors, Inaccuracies, and Omissions

Occasionally, information on the Site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, delivery estimates, inventory availability, subscription information, or other matters.

We reserve the right to correct errors, inaccuracies, or omissions; update information; or cancel affected orders where information was inaccurate, including after you submit an order, subject to applicable law. If a paid order is cancelled, we will provide an appropriate refund.

14. Prohibited Uses

You may not use the Site or Service:

  • For any unlawful or unauthorized purpose;

  • To violate applicable laws or regulations;

  • To infringe or violate our intellectual property rights or the rights of others;

  • To harass, abuse, threaten, defame, discriminate against, or harm another person;

  • To submit false, misleading, or fraudulent information;

  • To transmit malicious code, viruses, or harmful software;

  • To collect or track personal information about others without authorization;

  • To spam, phish, scrape, crawl, or interfere with the Site or Service;

  • To circumvent Site security features or access restrictions; or

We may suspend or terminate access to the Service for violations of this section.

The Site and its content, including text, product names, logos, graphics, images, design elements, software, and other materials, are owned by or licensed to Tea Runners and are protected by applicable intellectual property laws.

You may use the Site for personal, non-commercial shopping and information purposes. You may not reproduce, distribute, modify, sell, exploit, or otherwise use our Site content for commercial purposes without our prior written permission.

16. Disclaimer of Warranties and Limitation of Liability

To the extent permitted by applicable law, the Site and Service are provided on an “as is” and “as available” basis, without warranties or conditions of any kind except as expressly stated by us or required by law.

We do not guarantee that access to the Site or Service will always be uninterrupted, secure, timely, or error-free.

To the maximum extent permitted by applicable law, Tea Runners Inc. and its directors, officers, employees, affiliates, agents, contractors, service providers, suppliers, and licensors will not be liable for indirect, incidental, punitive, special, or consequential damages, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, arising from use of the Site, Service, or products purchased through the Site.

Nothing in these Terms excludes or limits liability, warranties, conditions, rights, or remedies that cannot lawfully be excluded or limited, including applicable consumer protection rights.

17. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Tea Runners Inc. and its directors, officers, employees, affiliates, agents, contractors, service providers, suppliers, and licensors from claims, liabilities, losses, and reasonable costs arising out of your breach of these Terms, violation of applicable law, or infringement of another person’s rights.

18. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by applicable law or severed to the minimum extent necessary, and the remaining provisions will remain valid and enforceable.

19. Termination

These Terms remain effective unless terminated by you or us. You may stop using the Site or Service at any time. Termination of your use of the Site does not automatically cancel an active subscription; subscriptions must be cancelled through your account or by contacting us.

We may suspend or terminate your access to the Site or Service if we reasonably believe you have breached these Terms, engaged in fraud or misuse, or created risk or harm to us, our customers, or others.

Any rights, payment obligations, liabilities, or provisions that by their nature should survive termination will survive termination.

20. Governing Law

These Terms and any separate agreements through which we provide the Service shall be governed by and construed in accordance with the laws of the Province of British Columbia and the applicable federal laws of Canada, without limiting any mandatory consumer protections available to you under applicable law.

21. Changes to These Terms

We may update these Terms from time to time to reflect changes to our products, subscriptions, services, practices, legal requirements, or other operational reasons.

When we update these Terms, we will post the revised version on the Site and update the “Last updated” date above. Where required by applicable law, we will provide additional notice before a change applies to you or your subscription.

Mobile Terms of Service

The Tea Runners mobile message service (the “SMS Service”) is operated by Tea Runners Inc., operating as Tea Runners (“Tea Runners,” “we,” “us,” or “our”). Your use of the SMS Service constitutes your agreement to these Mobile Terms of Service (“Mobile Terms”).

We may modify or discontinue the SMS Service or its features from time to time. To the extent permitted by applicable law, we may also update these Mobile Terms by posting revised terms. Where required by applicable law, we will provide additional notice of material changes.

By consenting to Tea Runners’ SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Tea Runners through your wireless provider at the mobile number you provided. Messages may be sent using automated technology. Promotional messages may include promotions, sales, product announcements, subscription offers, special offers, and cart reminders.

You do not have to sign up for SMS marketing in order to make a purchase. Your consent is not a condition of purchase, and participation in the SMS Service is voluntary.

We do not charge for the SMS Service, but message and data rates may apply based on your mobile plan. Message frequency varies. You are responsible for charges imposed by your wireless provider.

You may opt out of the SMS Service at any time by texting STOP to +1 479-259-1677 or by using an unsubscribe link where available in a text message. After you opt out, you may receive a one-time confirmation message. No further marketing SMS messages will be sent unless you opt in again or initiate communications with us.

We may change the phone number or short code used to operate the SMS Service. If we change our sending number, we will take reasonable steps to notify subscribers. Messages, including STOP or HELP requests, sent to a number we no longer use may not be received.

Wireless carriers are not liable for delayed or undelivered messages. You agree to provide a valid mobile number. If your mobile number changes, you should opt in again using your new number.

To the extent permitted by applicable law, we are not liable for failed, delayed, or misdirected delivery of information sent through the SMS Service or for actions taken in reliance on messages delivered through the SMS Service.
